Terms of Service

These Terms of Service ("Terms") govern your use of OpenStatsMc — the hosted Minecraft server statistics dashboard, plugin, and API available at openstatsmc.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
01The service
OpenStatsMc collects statistics from your Minecraft server — such as player sessions, playtime, server health, and leaderboards — and displays them on a dashboard, in Discord, and through an API. We offer a free tier and paid plans with higher limits.
02Your account
- You must provide a valid email address and verify it before using the Service.
- You're responsible for keeping your password safe and for all activity under your account.
- You must be old enough to form a binding contract in your country and provide accurate information.
- One person or organization per account; don't share credentials or impersonate others.
03Acceptable use
You agree not to:
- Break the law, infringe others' rights, or collect data you have no right to collect;
- Abuse, overload, or attempt to bypass the Service's rate limits or plan quotas;
- Probe, scan, reverse-engineer, or disrupt the Service or its infrastructure;
- Resell or sublicense the hosted Service without our written permission.
We may suspend or terminate accounts that violate these rules.
04Your data and content
You own the server and player data you send to OpenStatsMc. You grant us a limited license to store, process, and display that data solely to provide the Service to you.
You are responsible for the data your server collects and for complying with any laws and any obligations to your own players — including telling them what you collect (for example, IP addresses, which you can disable in the plugin). See our Privacy Policy for how we handle data.
05Plans, billing, and renewals
- Paid plans are billed in advance on a recurring basis (monthly or as shown at checkout) and renew automatically until cancelled.
- Prices and plan limits may change; we'll give reasonable notice of changes that affect an active subscription.
- You're responsible for any taxes that apply to your purchase.
06Refunds
24-hour refund. Try any paid plan risk-free. If you're not happy, request a refund within 24 hours of your first payment on that subscription and we'll refund it in full. To request one, email [email protected].
Outside that window, charges are payable in advance and are final: they are not refundable in whole or in part, for any reason, except where refund or cancellation rights are required by consumer law that applies to you. Cancelling stops future renewals; it does not refund the period you are already in, and closing your account does not convert unused time into money.
We may still issue a refund in cases we are not required to — we would usually rather put it right than argue about it. Doing so once is a decision about that situation, not a promise, a precedent, or a change to anything above.
Where the law gives you cancellation or refund rights that an agreement cannot remove, those rights stand and nothing in this section limits them. See 13c. If you asked us to start your plan immediately at checkout and confirmed that you understood the effect, that confirmation is what it says it is — but it does not reach rights that survive it, such as those arising when a free trial converts or a yearly term renews.
07Cancellation and termination
You can cancel your subscription or delete your account at any time from your profile. Cancelling keeps your plan active until the end of the paid period. Deleting your account permanently removes your account, servers, and their statistics. We may suspend or terminate the Service for you if you breach these Terms or to protect the Service or other users.
08Self-hosted version
OpenStatsMc also offers (or will offer) a self-hostable, open-source version. That software is provided under its own open-source license and "as is." These Terms cover the hosted Service at openstatsmc.com; when you self-host, you run and are responsible for your own instance.
09Availability and warranties
We work hard to keep the Service running, but it's provided "as is" and "as available," without warranties of any kind. We don't guarantee that it will be uninterrupted, error-free, or that data will never be lost. You're encouraged to keep your own backups of anything important.
09bThird-party services
The Service connects to products we don't operate — webstores such as Tebex, CraftingStore and NamelessMC, Discord, and the network and infrastructure providers that front our site. Those products are governed by their own terms, and they can change, break, rate-limit, or withdraw an interface without notice to us. We aren't responsible for their acts, omissions, downtime, or changes, and an interruption caused by one of them isn't a failure of the Service. Where a connection stops working, our obligation is to restore it if we reasonably can, not to compensate for the gap.
10Limitation of liability
To the fullest extent permitted by law, OpenStatsMc and its operators are not liable for any indirect, incidental, special, or consequential damages, or for lost data, lost profits, or business interruption. Our total liability for all claims relating to the Service is limited to the greater of (a) the total fees you paid us in the 3 months before the event giving rise to the claim, or (b) US $50. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.
10bYour indemnity to us
You decide what your server collects about your players, and you are the one with a relationship to them. So you agree to defend, indemnify, and hold harmless OpenStatsMc and its operators from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of: the data your server sends us; your failure to tell your players what you collect or to obtain any consent the law requires; your use of the Service in breach of these Terms or of any law; or content you publish through the Service, including on public pages and shared links.
This doesn't apply to anything caused by our own breach of these Terms. We'll tell you promptly about any claim we want covered, and you may take over its defence with counsel we reasonably approve, provided nothing is settled in a way that admits fault on our part or imposes an obligation on us without our agreement.
11Governing law and disputes
These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the State of California, USA, and the federal laws of the United States that apply there, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
12International users
The Service is controlled and operated by OpenStatsMc from the United States and is intended for users in the United States. We make no representation that the Service is appropriate or available for use outside the United States, and we are not responsible for compliance with the laws of any country other than the United States. If you choose to access the Service from outside the United States, you do so on your own initiative and are solely responsible for complying with your local laws.
13Changes to these terms
We may update these Terms from time to time. If we make material changes, we'll update the date above and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.
13bChanges to the Service
We may add, change, or remove features, and we may discontinue the Service entirely. Where a change materially reduces a feature you're actively paying for, we'll give reasonable notice, and if you don't want to continue you may cancel and we'll refund the unused portion of your current period. Free accounts may be changed or discontinued at any time. Nothing here prevents us from making changes required for security, legal compliance, or the stability of the Service, which we may make immediately.
13cGeneral
Severability. If any provision of these Terms is held unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in force.
No waiver. If we don't enforce a provision, that isn't a waiver of it, and it doesn't stop us enforcing it later.
Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service, and replace any earlier understanding on the subject.
Assignment. You may not transfer your rights under these Terms without our written consent. We may transfer ours in connection with a merger, acquisition, or sale of assets, on notice to you.
Nothing here removes rights you have by law. Some jurisdictions give consumers rights that can't be waived by agreement — including statutory cancellation or refund rights, and guarantees that can't be excluded. Where that applies to you, those rights stand and the clauses above apply only so far as the law allows.
